In June 2023, Paxton sued the Department of Education (DOE) over guidance extending Title IX protections to these categories. The guidance would have required Texas schools to allow biological males in women’s restrooms and other sex-specific spaces, risking federal education funding for non-compliance.

U.S. District Judge Reed O’Connor criticized the DOE for not following proper procedures and for attempting to rewrite Title IX. He called the revised policies unlawful and prohibited their enforcement in Texas.
